nuvio Terms of Use

These Terms of Use ("Terms") are an agreement between you and BubsNest UK Ltd. ("nuvio", "we", "us"). By tapping Agree, or by using the nuvio app, you accept these Terms. If you do not agree, do not use the app.
You must be at least 13 years old to use nuvio. If you are under 18, you may use nuvio only with the permission of a parent or legal guardian, who must supervise your use. If you monitor a child, you must be their parent or legal guardian or have that parent or guardian's permission. If you monitor another adult, such as an elderly relative, you must have their consent or lawful authority to do so.
1. What nuvio is, and what it is not
nuvio turns your own devices into a monitor: one device watches and listens near whatever you are keeping an eye on, a baby, a pet, an elderly relative, or a room in your home, and other devices in your household receive audio, video, alerts, and activity logs.
NUVIO IS NOT A MEDICAL DEVICE. It is not certified, cleared, or approved by any medical regulator. It does not diagnose, treat, prevent, or monitor any medical condition. It is not designed to detect or prevent Sudden Infant Death Syndrome (SIDS), apnea, choking, or any other health emergency.
NUVIO IS NOT A SUBSTITUTE FOR ADULT SUPERVISION. It is a convenience that helps attentive people, and nothing more. You remain fully responsible for the safety and care of whoever you are monitoring at all times.
nuvio is not an emergency service. In any emergency, contact your local emergency services immediately.
2. Alerts can fail. Set up for reliability, and do not rely on the app alone
Sound detection, sleep inference, presence and motion detection, and the other automatic features use machine learning. They are probabilistic: they can miss real events, report events that did not happen, and be delayed. Alerts also depend on things outside our control, including your devices, their microphones and cameras, battery and power, WiFi and internet service, operating system restrictions, and notification settings.
You are responsible for setting up and testing the app: keep the monitor plugged in and its microphone unobstructed, keep permissions (microphone, camera, notifications) granted, disable battery restrictions when asked, keep your phone's volume and notifications on, and test that alerts reach you before relying on them. Check on whoever or whatever you are monitoring directly and regularly regardless of what the app shows.
3. Place devices safely
Keep all devices, cables, and cords at least 1 metre (3 feet) away from any cot, crib, bed, or sleeping area, and always out of the reach of children and pets. Cords are a strangulation hazard. Never place a device inside or on the edge of a cot. Mount or rest devices so they cannot fall onto a person or animal. Devices can become warm; do not cover them, and keep them away from bedding.
4. Health, development, and AI content is not medical advice
The app lets you log feeds, sleep, temperatures, symptoms, medicines, and milestones, and it generates summaries and insights, some produced by artificial intelligence. All of this is for your information and record keeping only. It may be incomplete, inaccurate, or wrong. It is not medical advice, and no part of the app creates a doctor-patient relationship. Always consult a qualified healthcare professional about health, feeding, sleep, and development, whether for a child or an adult in your care, and a vet about an animal's health, and never delay seeking care because of anything the app shows.
5. Privacy and your recordings
Detection runs on the monitor device by default. Live audio and video streamed to your phones is encrypted in transit. Recordings, snapshots, and activity logs are stored on your own devices unless you choose a feature that uploads selected media, such as cloud processing, cloud clips, sharing, support, or backup. A small amount of service data (such as push notification tokens, connection signaling, liveness status, incident metadata, and subscription state) passes through our servers to make remote access, alerts, monitoring health, and account features work. We do not sell your media or use it for advertising. Our Privacy Policy describes this in detail and forms part of these Terms.
You are responsible for the recordings you make. Laws about recording audio and video vary by place; obtain any consents required where you live, including from caregivers, household members, and visitors who may be seen or heard.
6. Your household and pairing codes
Anyone who scans your pairing code, or joins your household, can watch and listen to your monitor and see its activity log. Treat pairing codes like keys: show them only to people you trust, and remove devices you no longer trust. You are responsible for the people you invite.
7. Subscriptions and the free trial
Every new household receives a 7-day free trial of every nuvio feature, including monitoring from anywhere. The trial does not require a payment method and does not convert into a paid subscription. When it ends, you can choose any available plan to continue paid monitoring features. Subscriptions are billed and auto-renew through the App Store or Google Play under their terms; you can cancel any time in your store account settings, effective at the end of the current period. Store refund policies apply. When a trial or subscription ends, your logged data remains yours and stays accessible on your devices. Prices and plans may change; changes apply from your next billing period after notice.
8. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use nuvio on devices you own or control, for monitoring a child you are responsible for, an adult who has consented, an animal in your care, or property you own or control. You must not use nuvio for illegal activities, including unlawful surveillance, stalking, harassment, or recording anyone without consent where the law requires it. You may not reverse engineer, copy, resell, or interfere with the app or its services.
9. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS, INJURY, OR DAMAGE ARISING FROM MISSED, FALSE, OR DELAYED ALERTS, UNAVAILABILITY OF THE APP, OR YOUR RELIANCE ON THE APP INSTEAD OF DIRECT SUPERVISION OR PROFESSIONAL MEDICAL CARE. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Nothing in these Terms excludes liability that cannot be excluded by law, including where applicable liability for death or personal injury caused by negligence.
11. Indemnity
You will indemnify us against claims arising from your unlawful recording of others, your breach of these Terms, or your use of the app contrary to Section 1 through Section 4.
12. Changes and termination
We may update the app and these Terms; material changes will be shown in the app, and continued use after acceptance of the updated Terms means they apply. We may suspend or end service for breach of these Terms. You can stop using the app at any time; Sections 4, 5, and 9 through 13 survive.
13. Governing law and contact
